Can the Stormcloaks beat the Thalmor?
The Stormcloaks can defeat the Thalmor as well. The Redguards did it, surely the Nords can do it in (terrain advantage) Skyrim. The only thing holding back the Empire is bureaucratic politics.
Is it better to side with the Stormcloaks or Imperials?
The ranking system in the Imperial Legion is all about hard work and the title progression feels appropriate compared to the relatively unorthodox Stormcloaks. Moreover, the armor and weapons of the Imperial Legion are of higher quality and look arguably better than the Stormcloaks’ cheap-looking gambesons.

After Ulfric is dead, Tullius and Rikke will head outside. Follow them out and watch as Tullius gives a speech to the assembled Imperial soldiers, thanking them for their service. After the completion of this quest, the Imperials will install a new Jarl, Brunwulf Free-Winter.

How to avoid combat with a Thalmor Justiciar?
The only way to avoid combat is to cancel conversation if things are turning accusational. If the Dragonborn enters conversation with a Thalmor Justiciar twice, the second conversation will always end with the Justiciar deciding to attack the Dragonborn, regardless of the dialogue option chosen.
